A viking ship appears on the horizon, a likeness of Alice Coltrane carved into its bow. Rare birds flock together to sing Francoise Hardy as soul hits. A sunset of blips and bleeps fills the air.

Avatar 9:55am dale:

i wonder if anyone who recorded this had to pay the chiffons a royalty?

This is obviously a ripoff of "He's So Fine."

Hey trouble and all!
I got to see A Tribe Called Red last week.

Avatar Swag For Life Member 9:58am sphere:

dale & Roberto: I believe Harrison was sued by the guy who wrote "He's So Fine" and lost.
  9:58am Mark R:

For anyone who hasn't seen "What Happened, Miss Simone?" it's a wonderful doc that came out a couple years ago. If you love Nina, I think you'll love the film, too.
Avatar Swag For Life Member 9:59am melinda:

I also heard that Harrison continued to challenge the ruling.
Avatar 10:00am kwhitehead:

This Nina track giving me goosebumps.
Avatar Swag For Life Member 10:00am Andrew Waterloo:

@Mark R. I love the opening sequence where she's standing by the piano while the audience applauds.
Avatar 10:01am dale:

i know he was sued and lost. i was just wondering how that worked out for everyone who covered harrison's song. did ronald mack the writer of the chiffons song get royalties?
Avatar Swag For Life Member 10:01am Webhamster Henry:

Can't stop the Nina!
  10:01am Mark R:

The nutty thing about that is that Phil Spector produced both records. So you'd think that when he was sitting at the George sessions, he might have said, "Y'know, something about this tune rings a bell."
Avatar Swag For Life Member 10:02am sphere:

the whole He's So Fine lawsuit is fascinating. Wikipedia: en.wikipedia.org...
Avatar Swag For Life Member 10:02am Guido from Cologne:

Hello Trouble!
Avatar 10:02am Roberto:

I was facetiously referring to said lawsuit.
Avatar 10:02am rebuketodali:

@kwhitehead Ditto. This is so divine.
Avatar Swag For Life Member 10:03am Cooh John:

I like some Trouble in the morning.
Avatar 10:05am dale:

harrison had to buy the publishing company from whoever owned it when the suit finally came to trial and that took another ten years to suss out, so it was a twenty year process. i guess some lawyers did well anyway.
  10:05am Mark R:

Wow, that's a lot more complicated than I ever knew, Sphere. Thanks. Allen Klein was a real snake, wasn't he?
Avatar 10:05am rebuketodali:

Avatar Swag For Life Member 10:18am upsetter5001:

Good Morning Troubleland!
Avatar Swag For Life Member 10:19am Guido from Cologne:

The Italians pronounce my name better and I like it!
Germans say "Geeedoo', which comes via the Swiss-German transmission. (The name is very common in Switzerland.)

pronounce as every average American would do. It is close to the Italian original and it is nice. At least I feel more "international".

Good morning, Trouble! Thank you for working so hard to keep this vast cultural channel alive and well! Also, that sculpture is badass- where is it located?!?
Avatar 10:23am Roberto:

Similar...yet different.
Avatar 10:24am Trouble:

thank you! itzall!! not sure if someone owns that sculpture, but it was shown in the NY gallery for lonnie holley, james fuentes gallery
Avatar Swag For Life Member 10:25am Vivian:

@rebuketodali- what time is the collaboration with Lonnie Holley tonight?
Avatar Swag For Life Member 10:26am Vivian:

Disregard, checked out link..
Avatar Swag For Life Member 10:26am Itzall Ablurr:

Thank YOU! Mr. Holley is an old acquaintance, used to see him around Atlanta quite a bit. I don't recall that he worked in plasma-cut iron sheeting, but that certainly has all of the hallmarks of his work and I LOVE IT.
Avatar 10:27am Trouble:

I bought that Emergency Ward record b/c of Marty playing it too! sooo good.. B side should get some play too! "poppies" is gorgeous.
  10:36am Listener Gregory:

As I understand it, the laws of plagiarism don't require intention or even knowledge of the original (though it helps to prove copying). If a new song is too similar to the melody of an old one, the writers can be sued.
Avatar Swag For Life Member 10:37am Listener Scott:

IP lawyer here: George Harrison case didn't hinge on similarity of both songs having three words in compared sample; case hinged on similarity of the melodies.

Avatar Swag For Life Member 10:39am Planet Tyler:

George <3 <3 <3. Remember when Sinatra would always introduce "Something" as a Lennon & McCartney song when onstage? There's a live bootleg GH album from '74 and George does "Something" in schmaltzy Sinatra-style in return
Avatar Swag For Life Member 10:40am Asheville Jon:

man, the 80's were so messed up.
Avatar 10:41am Roberto:

This had to have been the inspiration for "yo homes, smell ya later."
Avatar Swag For Life Member 10:42am Planet Tyler:

As for "plagiarism" - well, that's how music works. If y'all haven't read "Deep Blues" by Robert Palmer it's fantastic and also a history of how early blues tunes really "belonged" to no one. Such a good book on music!
Avatar Swag For Life Member 10:43am Ike:

Never heard that Biz track before! That was totally bitchin'.
Avatar Swag For Life Member 10:44am rsj:

eric b never sleeps either
Avatar Swag For Life Member 10:44am Passaic River Blues:

Cold Chillin' Records really was so good. I don't think they ever put out a bad album.
Avatar Swag For Life Member 10:44am rsj:

but neither does chuck norris they say
  10:45am Listener Gregory:

@Planet No doubt you're right, but once money gets involved, everyone wants to "own" their music. In traditional blues music, no artist made any money on their recordings, so there were no lawsuits.
Avatar Swag For Life Member 10:45am Gaylord Fields:

[waving Trouble-ward this AM]

When I met Biz Markie in the late '90s, as part of my day job, he made fun of my given name. So I responded with "You're one to talk...Marcel!" He chuckled and conceded the point (a victory for all Gaylords everywhere).

(My apologies to the WFMU DJ Marcel M.)
  10:46am Adrian in London:

@Trouble On Chuck Berry, totally agree that the way he was treated is different to that politician. But by the same token if a politician installed cameras in his restaurant bathroom to film women he'd, hopefully, be drummed out of public life forever, and rightly so. But hey, Chuck Berry, rock 'n' roll... it leaves a rather queasy feeling with me.
Avatar Swag For Life Member 10:48am Gaylord Fields:

@Adrian in London: Recent events make me not so certain that what you say with regard to politicians holds anymore.
Avatar 10:52am Trouble:

i am not giving chuck a pass, @ adrian. buti spoke of the time that he was arrested on the mann act. the cameras in the bathroom happened much later...if you are looking for male miscreants the music world is full of them
Avatar Swag For Life Member 10:52am Passaic River Blues:

@GF: That is so, so cool. In my fantasy life, I spend many a Saturday promenading through the Albee Square Mall with my man Biz Markie and Mr. Marley Marl.
Avatar 10:52am Trouble:

bonjour gaylord!!
  10:53am Adrian in London:

@Gaylord Quite. Maybe they'd be promoted :-(
Avatar Swag For Life Member 10:54am Priscilla:

Nelson George had interesting take on Chuck Berry in this radio interview:
Avatar Swag For Life Member 10:56am Passaic River Blues:

@GF (again): Yeah, it'd be recontextualized as just good ol' "locker-room voyeurism", sort of like the tidal wave of "locker-room treason" justifications we shall be hearing very shortly.
Avatar Swag For Life Member 10:59am Itzall Ablurr:

Bombino were (was?) excellent opening for Robert Plant a few years ago. Do they still tour?
Avatar 10:59am Marcel M:

1 point Gaylords, 0 points Marcels.

Back when I worked at Tower Records my manager was into the old school VHS trading. I saw the infamous Chuck Berry golden showers video. Am I proud of that? I'm not sure... still have not decided.
Avatar Swag For Life Member 11:01am Andrew Waterloo:

Avatar Swag For Life Member 11:12am Passaic River Blues:

Seeing Mary Lattimore is mighty tempting.
Avatar Swag For Life Member 11:12am Asheville Jon:

looks like the time/space/calendar continuum bit Trouble again today
Avatar Swag For Life Member 11:13am Planet Tyler:

@Listener Greg - "Deep Blues" covers music before there was even a thought of selling it, or recording it. It's a time we are so unfamiliar with, we forget it existed.
  11:14am Kapo Strano:

I'm listening, Trouble. I listen to the FM so I am not forced to look at a computer if I don't want to, because I look at computers plenty. I was on a team at DoubleClick in the year 2000 that figured out how to serve ads to mobile devices and we agreed a.) it was a bad idea, b.) others would figure out how to do it anyway eventually and, c.) we few should strive forever to prevent it in whatever little ways we could.
