Hey Therese and all
Avatar Swag For Life Member 9:39pm Pauly from Clifton:

From Jessica Winter in the New Yorker, "When Roe was decided, a married woman in the United States needed her husband’s permission to get a credit card, something that did not change until 1974. No state outlawed marital rape until 1975. No man was found liable for sexual harassment until 1977. Pregnancy was a fireable offense until 1978. Alito does not itemize forms of gender-based subjugation that persisted after Roe, many of which might be persuasively argued as “deeply rooted in this Nation’s history and tradition.” Alito's argument is a slippery slope. Where the fuck do I live?

Listening to your break there I was thinking that "bodily autonomy" is a pretty good clincher. Choosing what happens inside your own body seems like a basic assumption that should apply to any free individual person.
Avatar 9:40pm TDK60:

My take: Yes, vote, write legislators. But pressure on the streets is needed. Nothing gets change without turmoil.
Avatar 9:41pm Therese:

Hey Mariano! How's your JazzFest?
Avatar 9:42pm Therese:

@Pauly from Clifton: My grandmother wanted to buy a condo at the Jersey Shore. She was going to pay in cash. The realtor wouldn't proceed without an okay from her husband. This was in the late 1980s.
  9:44pm Robm:

@Therese I hope your grandma got the condo
  9:45pm Minnesota Jim:

Ooh, rolling right into the next Janelle Monae song from the album. So smooth.
Avatar 9:45pm Therese:

@Robm: oh, she did. And that realtor thought twice about asking the next woman who came in if her husband (or worse, FATHER) okayed the purchase.
Avatar 9:46pm Therese:

@Minnesota Jim: that's what you call a happy accident.
  9:46pm Robm:

@therese or the realtor got their ass fired
Avatar 🎸 Swag For Life Member 9:47pm mariano:

Hey, Therese (and all of yous)! Too busy with work for JazzFest, sadly, though I did catch Ween last Friday, three-hour show. It's starting to get hot but it's still that lovely time of the year when it's magical outside and the air is full of jasmine and orange blossom.
9:47pm Bob in DC and/or Virginia:

For some reason I keep remembering you playing "Yoshimi Battles the Pink Robots" right after the Kavanaugh hearings and feeling convinced that this was your tribute to Christine Blasey Ford (which of course I could be deeply wrong about), and thinking about how that moment led to what we're witnessing now.

In any case, thank you for your show.

Avatar Swag For Life Member 10:23pm Revolution Rabbit Nov63:

The wealthy & the powerful will always have access to as much abortion as they will ever want. & - they will use it. & - we all know it.
So this isn't a Moral issue whatsoever.
Facts don't support that.
Facts like all the many conditions for which abortion is the only way of saving the mother's life. & so many more. You know them.
Obviously this is the Politics of Emotion - especially approaching a crucial Midterm Election. My hope there is they gigantically miscalculated ! & have wildly energized & unified their opposition.
It is propaganda in the Culture Wars.
It is War against the Poor & against Women.
Not unrelate to all of these :
It is desperate War against Democracy itself
- because the Majority is demonstrably & unequivocally & overwhelmingly in favor of Reproductive Rights. It's not close to being close. Don't be deceived about that.

  10:31pm Rachel Bo Bachel:

Robm! Yes I understand how she feels 100%. We can’t be complacent re: separation of church and state. And I say that as a religious Jew and proud American! Go Therese!!!
Avatar Swag For Life Member 10:33pm Revolution Rabbit Nov63:

Has been observed that it is easier for the RightWing to just fly the flag of some outrageous ideology - & get its followers in single file to the Polls. But being Liberal means literally to tolerate wider views. So tho we are a clear & significant Majority - it's harder to get us to the Polls & marking the same box. That's up to us.
  10:33pm Robm:

@Rachel so do i, could feel the rage
  10:34pm dano59:

Absolutely, Rev. mobilization & motivation needed to fight fire with fire
Avatar 10:35pm TDK60:

Revrab, I'm not liberal. Rather, radical.
Avatar Swag For Life Member 10:35pm Revolution Rabbit Nov63:

Not using the term 'ProLife' is important I think - because it is a propaganda war. This is what the Gingrich-Rove was all about: killing off bipartisan civility & actually helping the nation whatsoever - & instead villifying the other other Party in the Press &tc. - whatever the cost to us all.
  10:35pm tim from washington:

Hi Therese and everyone. I love recent Marianne Faithfull. I missed the previous mic break. I’m 49 years old. This past year I’ve really been changing my thoughts about our country and society. I always thought that society moves forward and progresses albeit slowly with many bumps in the road. But with the reactionary turn from the left in regard to the nuances of free speech, the bald faced hypocrisy from the right, the return of war that could ignite nuclear war and now this impending stacked court overturn of Roe I think this is the shittiest I’ve ever seen it. So I’ve been thinking that society doesn’t progress . Now I’ve got to figure out how to sanely live within a retrograde state.

Avatar Swag For Life Member 10:39pm Revolution Rabbit Nov63:

@TDK60: It depends entirely on the definitions & what have become the conventions around them. & this is a perfect example of what I'm trying to illustrate with that... What happened @ the DNC in 1968 should be better known & considered by all. The Democratic Party & the Left have long had this rift, in other words...
Avatar Swag For Life Member 10:41pm Revolution Rabbit Nov63:

...the Nazis in Germany won actual election - because too many other parties divided the vote...
Avatar Swag For Life Member 10:42pm Revolution Rabbit Nov63:

I hope that everybody recognizes that seven white old men decided Roe v. Wade. And Obergefell overturned Bowers...undemocratically. Every court decision has a winner and a loser. Stop whining if you turn out for the moment to be a loser.

winners have the courage to post their names @?

Courage. That's a good one.

that's always how it goes.. so back to the point.. winners and losers are fine but it gets tricky when lots of ppl think those who won are not right.. this is not a sports game we're talking about
  11:19pm Dean:

Here I am, Mr. Courageous.

Address my point, which is that the Supreme Court has not infrequently overturned its own precedent. When the outcome is to your advantage, you celebrate it. When not, you whine. This strategy won't work for you nor for those of us, including me, who despise the outcome suggested by the leaked opinion.

The true overwhelming Majority support Reproductive Rights. So - it's a question of Representative & Democracy. Justices get Appointed by supposed Representatives - but the Republicans in the Senate represent 43 Million fewer of us than the Democrats there. The Republicans blocked Democratic POTUS's nominees - & bumrushed their own.
So if your argument is about Fariness & Civility
...No.

"Star Wars was not really feminist." Therese.

Noble effort!
  11:28pm Dean:

Ike, you're way smarter than that. Of course you can figure out my point.

The outcome of this supposed decision is legitimate in one respect: the Court decided it according to its protocols. It very well might not be logically or doctrinally legitimate. It might be a "bad" decision. But guess what? The arbiters of what is a bad decision are the Court (oops, that's a problem) and the legislature.

I'm only complaining--okay, whining--about how folks bitch that the Court is "political." That goes without saying.

The Court is precisely designed NOT to be democratic. Its purpose is precisely to overturn democratically decided laws and policies. This country is not 100% about "majority rules." The Court's job is to check stupid majoritarian policies and laws.

Avatar Swag For Life Member 11:35pm Revolution Rabbit Nov63:

You say it goes without saying the Court is Political - & then you say, in so many words, that the value of the Court is that it is not - it is merely Legal. It's self-contradictory nonsense trying to disguise itself in verbosity.
  11:37pm Dean:

Okay, RevRab. Solve that problem.

Sure @Paulo, I'm always in favor of throwing children into the sea, LOL!

More to the point, I'll assume you celebrated Obergefell, as I did (mostly). Why was that okay for you? Merely because it coincided with your preferences?
Avatar Swag For Life Member 11:39pm Revolution Rabbit Nov63:

It's not the Legislative Branch. It's not their job to overturn Laws made by the Elected Congress. It's their job to apply them.

' Obergefell v. Hodges, 576 U.S. 644, is a landmark civil rights case in which the Supreme Court of the United States ruled that the fundamental right to marry is guaranteed to same-sex couples by both the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. That is - the Law.

Maybe so - but you're accusing us of 'whining' about serial abuses of good will, fairness, honesty, transparency, democratic process & long long civil precedent. If, say - it were the other way around - & Republican candidates had won't the popular vote by millions - but lost the Elections - you reckon there'd be any - 'whining' ? Sir ? Or wouldd the Right be exhibiting perfect chivalry in the face of critical defeat - because 'Rules'...

  🎸 11:50pm Benoni:

@Dean. No, it is not the job of the Supreme Court or any Court in the US to "check stupid majoritarian policies." The Court should not act as a super legislature or replace the policy decisions of the states or federal government with policies it prefers. The Sup Ct took away a civil right based on what was an unbroken string of its own decisions. "Precedent on precedent" as one person previously put it. The Sup Ct's breaking of stare decisis without any newly arising justification will weaken the rule of law, and the legitimacy of its own court. If you still think that is a "win" then that's on you.
Avatar Swag For Life Member 11:50pm joe mulligan:

Avatar Swag For Life Member 11:52pm Revolution Rabbit Nov63:

...as it is they've stolen two Presidential Administrations from the popular vote - & exhibited the polar opposite of humility or civility @ any opportunity. In fact - oceans & mountains of rhetorical abuse as a basic & fundamental modus operandi. Are we the 'whiners', Sir? Not, say, civility conceding Elections we've lost? Or have we literally stormed the Capitol to overthrow an Election - murdereing police & thtreatenting the lives of Senators? Strictly as a hypothetical, you understand... Do our whines offend your fine senses? Then please, accept our humble apologies for such anegregrious offense to the Civil functioning of these great Untied States.

Really powerful show tonight, Therese! Good stuff. Thanks for putting it all together!
  11:55pm Dean:

"Whining" is shorthand for complaining about political outcomes without offering corrections to those outcomes.

Sorry, Benoni, but you're simply wrong. The "super legislature" argument is not correct. The Supreme Court's job, since Marbury, is to overturn unconstitutional legislation and to overturn bad precedent. And I suspect we all celebrated when the Court did that in, say, Obergefell. Or no? Are you angry that the Court legalized same-sex marriage?
Avatar 🎸 Swag For Life Member 11:56pm Ken From Hyde Park:

Avatar Swag For Life Member 11:57pm Aitch:

In Australia you have to vote, elections are always on a Saturday and there's loads of early voting options. You get a fine if you don't vote, but everybody does, because why wouldn't you? Vote order on the forms is drawn from a hat in each electorate so dumb votes are averaged. The sheer lack of active democracy in the USA quite baffling to us
  11:58pm Dean:

Aitch, you are on the money. This is exactly what people should "whine" (complain, whatever) about.

  🎸 12:01am Benoni:

@ Dean. I'm guessing you're not a lawyer. Sup Ct's job has not change. The Sup Ct. has broken precedent (thus far) when finding more rights—as it is a relatively brief Constitution it is exposing.
