And take lots of photos of the mold, which I'm sure you've already done. I've spent more time than I care to discuss in housing court in NYC (111 Center Street!) and in Jersey City. It sucks. It's scary. It's demoralizing. I still have PTSD from it. But when you win, it feels very, very good.

	♥ 10:31pm slugluv1313: @ Fox -- there should still be ways to withhold rent when landlords refuse to make required repairs -- you gotta prove that you have the rent $$ (set up a specific account in which to keep it), and like Wendy says, DOCUMENT EVERYTHING! if i remember correctly, NJ Legal Services should have "Tenants Rights and Responsibilities" with specific instructions -- when you write to the landlord, you list specific violations, etc. -- and send any letters via Certified Mail (and YES i have had to do this before, my last year in college was like a crash course in tenant/landlord laws in NJ, and i have tried to stay up to date)

Write everything down, including dates you tried to contact your LL, the results, etc. If you end up going to court pro se (representing yourself), you'll present better if you're organized. And, if a lawyer helps you, they'll make a stronger case if you have lots of documentation.

	♥ 10:41pm PaulRobeson1920: Tenants have the “Right to live in a healthy, safe, environment” At least in New York... when we withheld the rent and asked the landlord to clean out the forced air ducts in the place we rented in Oswego, NY (Claimed to have been cleaned with in the last two years and was clearly lying) they found 4 dead birds in the intake vent and all the kids got their Legos back. Yep, document it all!

	10:44pm Fox: I have SO MUCH DOCUMENTATION. In fact, I am pretty sure I took photographs of the whole apartment when I first moved in, becaus eI've been dicked by landlords so often. I have an audio recording of me talking with the landlord about the leak in my kitchen that caused the mold, talking about how that water damage was present before we even moved in. I have an email from my landlord explaining to me that he tore the moldy plaster down and left it like that for a week, AND I HAVE PHOTOS.

	10:46pm Fox: When I got sick from his pulling the wall open, I went to the ER, the clinic, and a private doctor for the pain at the base of my throat. Nobody would test me for mold, but they did test other stuff. Then Covid happened. Months later I got my test results, and I've suddenly become hypothyroid. which can happen from thyroiditis after high levels of mold exposure.

I refused to let him treat the mold with chemicals, and demanded he get a professional "as a reasonable accommodation of my disability" (which puts it in the realm of the ADA) but he still refused. There's mold in my bathroom, too. And he bought the special bathroom paint for it, brought it over, and it's been sitting in the hallway for at least two months now.
	10:50pm Fox: The stove started shorting out and tripping the outlet. He took out the bulb. That didn't work. So his answer was to get an extension cord and plug it in to a different outlet in the kitchen.

It's a long slog--but first and foremost is to have a record of complaint with the landlord about any mold issue with an assessment and determination that mold has been found. My experience was paying for a company to test the space that I then deducted that expense from any rent. That woke them up towards remediation. Get an assessment of mold presence and a legal assistance.

	10:57pm Fox: Chop Scott- After the landlord plastered over the wall he tore apart, THEn he agreed to have a mold inspector come. I think he assumed he'd sealed it all in? But they came up with three types of mold, one of which the toxic black kind. He still refused to hire someone to fix it, and was determined to fix it himself. Cheap bastard.

The landlord KNEW I had health problems because I'm on Disability, and he KNEW there were leaks that he wasn't fixing. I've been having debilitating headaches, angry bladder, terrible brain fog, and trying to fight Lyme Disease, and twice recovering from punctured lung, while living in a moldy apartment. grrrrrrr.

And take lots of photos of the mold, which I'm sure you've already done. I've spent more time than I care to discuss in housing court in NYC (111 Center Street!) and in Jersey City. It sucks. It's scary. It's demoralizing. I still have PTSD from it. But when you win, it feels very, very good.

	♥ 10:31pm slugluv1313: @ Fox -- there should still be ways to withhold rent when landlords refuse to make required repairs -- you gotta prove that you have the rent $$ (set up a specific account in which to keep it), and like Wendy says, DOCUMENT EVERYTHING! if i remember correctly, NJ Legal Services should have "Tenants Rights and Responsibilities" with specific instructions -- when you write to the landlord, you list specific violations, etc. -- and send any letters via Certified Mail (and YES i have had to do this before, my last year in college was like a crash course in tenant/landlord laws in NJ, and i have tried to stay up to date)

I have an audio recording of me talking with the landlord about the leak in my kitchen that caused the mold, talking about how that water damage was present before we even moved in. I have an email from my landlord explaining to me that he tore the moldy plaster down and left it like that for a week, AND I HAVE PHOTOS.

	10:46pm Fox: When I got sick from his pulling the wall open, I went to the ER, the clinic, and a private doctor for the pain at the base of my throat. Nobody would test me for mold, but they did test other stuff. Then Covid happened. Months later I got my test results, and I've suddenly become hypothyroid. which can happen from thyroiditis after high levels of mold exposure.

I refused to let him treat the mold with chemicals, and demanded he get a professional "as a reasonable accommodation of my disability" (which puts it in the realm of the ADA) but he still refused. There's mold in my bathroom, too. And he bought the special bathroom paint for it, brought it over, and it's been sitting in the hallway for at least two months now.
	10:50pm Fox: The stove started shorting out and tripping the outlet. He took out the bulb. That didn't work. So his answer was to get an extension cord and plug it in to a different outlet in the kitchen.

It's a long slog--but first and foremost is to have a record of complaint with the landlord about any mold issue with an assessment and determination that mold has been found. My experience was paying for a company to test the space that I then deducted that expense from any rent. That woke them up towards remediation. Get an assessment of mold presence and a legal assistance.

But they came up with three types of mold, one of which the toxic black kind. He still refused to hire someone to fix it, and was determined to fix it himself. Cheap bastard.
